School District Prevails in Summary Judgment Motion
When a school district was accused by one of its teachers of violating the Americans with Disabilities Act (ADA) and Age Discrimination in Employment Act (ADEA), the school district contacted Larkin Hoffman. The Larkin Hoffman team, led by Chris Harristhal with assistance from Julia Halbach, achieved a summary judgment on behalf of the school district. The school district argued that the plaintiff’s disease did not render her disabled as then defined under the ADA. Additionally, the school district argued successfully – in one of the first cases to raise the issue – that recent legislative amendments to the ADA did not apply retroactively to a pending action.
